Investment Risk Disclaimer

This Investment Risk Disclaimer covers the analytical features of Voxum and voxum.net, provided by Voxum Software Technology - FZCO (the “Company”, “we”). It supplements the Terms of Use. “You” means a user of these features.

1. Purpose of Voxum

Voxum provides a strategy builder, backtesting (testing rules against historical data), a trading journal, algorithmic signals, analytics and artificial intelligence (AI) responses. These tools help users study markets, including currencies, metals and cryptoassets.

Results may reflect your selected strategy, trade and risk settings, but do not comprehensively assess your financial circumstances, capacity for loss or the suitability of an investment. They neither oblige you to buy or sell nor guarantee a return. Do not base a trading decision solely on a Voxum result.

2. No guaranteed outcome

We do not promise profit, a particular return, the accuracy of every signal or uninterrupted data availability. Errors, delays, missing data and technical failures are possible. Mandatory service-quality requirements and your remedies for breach of contract remain unaffected.

Past performance, backtests and simulations do not guarantee future returns.

3. Risk of loss

Prices can change sharply and liquidity may be insufficient to execute at the desired price. Leverage increases risk. Depending on the instrument, broker terms and applicable protections, losses may exceed the initial deposit.

Cryptoassets also involve custody, technology, counterparty and regulatory risks. Do not trade with money whose loss would jeopardise essential expenses. Assess your experience and risk capacity before placing a real trade.

4. Your decisions

You must check input data, strategy settings, position size, fees, taxes and the terms of your chosen broker or exchange. A virtual deposit, calculated position size or risk indicator in Voxum does not mean that corresponding funds exist in a real account.

You are responsible for your trading decisions and restrictions applicable to you. This does not relieve the Company of liability for its own conduct where mandatory law provides otherwise.

5. Artificial intelligence

The support assistant, Ask AI trade analysis, strategy adviser and backtest analysis have different purposes and plan availability. AI can make mistakes, invent explanations and miss recent events or relevant context. Verify facts and calculations before relying on them.

Scores and comparisons based on historical results are not a validated probability of success for the next trade. Calling a feature “AI” does not mean every indicator is produced by a neural network.

Processing a request to answer it is separate from voluntarily using new conversations to improve models. Your choice in “Help improve Voxum AI” is explained in the Privacy Policy.

6. Strategies and user materials

6.1 Your rules

You select strategy blocks and parameters and check that they work together correctly. Being able to save or run a strategy does not certify its profitability or suitability for real trading.

6.2 Built-in templates

Templates illustrate rules. Their presence is not a recommendation to trade. Cloning creates a copy that must be checked against the instruments, period and settings you choose.

6.3 Sharing

Another author may make errors, select a favourable period or omit relevant circumstances. Independently verify shared materials. Availability through a link or code does not mean the Company has verified another user's performance.

7. Backtests

A backtest simulates available historical data; it is not real trading. Results depend on the period, candle quality, entry and exit rules, fees and calculation assumptions. Simulation does not necessarily reproduce actual spreads, slippage, latency, market depth or execution within a candle.

Fitting parameters to past data can overstate a strategy's usefulness. Compare periods and consider trade count, drawdown and risk, not just total profit.

History depth, instruments, strategies, run quotas and queues depend on your plan and available data. The application constrains period selection; the server may reject an unavailable request. Automatic shortening of every incorrectly specified period is not guaranteed.

8. Virtual positions and no custody of investment funds

The analytical features, journal and virtual positions described here are not a brokerage account, placement of a real order or custody of your investment funds. Recording a trade in Voxum does not execute it on an exchange. Subscription payments purchase software features, not an investment.

This description does not automatically cover separate execution products or external services offered under their own terms. Connecting to such a product requires separate consideration of its actual permissions and risks.

9. External services and data

Market data, economic events, app stores, notifications and external links also depend on third parties. Delays, corrections and loss of availability are possible. Check important values against their source and actual execution conditions. The Company's responsibility for its selected providers is determined by applicable law and is not automatically excluded.

10. Regulation

A feature's legal classification depends on its actual operation and applicable law. This Disclaimer does not replace a required authorisation, certify regulatory approval or establish an exemption from regulation.

Store availability does not mean every instrument is lawful to use in your country. Both the Company and users must meet the requirements applicable to them.

11. Company liability

To the extent permitted by law, the Company does not compensate market losses, lost profits or other indirect losses arising from independent user trading decisions. Where a contractual cap is lawful, aggregate liability for Service-related claims is limited to the greater of USD 500 or the amounts you actually paid for the Service during the 12 months before the event giving rise to the claim.

The cap does not apply to fraud, wilful misconduct, gross negligence or liability that cannot legally be limited. It does not remove mandatory consumer rights, statutory compensation, refund rights or remedies for defective services. This section operates together with section 12 of the Terms, without cumulative caps or double recovery.

This also includes liability for death or personal injury where it cannot lawfully be excluded or limited.

12. Third-party claims

To the extent permitted by law, you are responsible for substantiated third-party claims and reasonable documented costs caused by your culpable violation of law, third-party rights or the contract. This does not cover consequences attributable to the Company or its providers.

We will notify you, allow a reasonable opportunity to participate in the defence and not settle on terms imposing obligations on you without your consent. Lawful use of Voxum alone does not require you to pay all Company expenses.

13. Laws and taxes

You must comply with restrictions applicable to your trading, access to instruments and tax reporting. Voxum analytics and records do not replace official broker statements or a tax return. The Company remains responsible for its own legal obligations.

14. Age and capacity

The Service is for people aged at least 18 who have capacity to contract. Any higher age or additional requirements under applicable law must also be met. The Service is not intended for children.

15. Acknowledgement

Read these risks and the Terms before using analytical features. Acceptance is not a waiver of mandatory rights or consent to optional conversation processing or analytics cookies.

16. Changes

The date above is the revision date. For new users, this revision applies after the terms are properly presented and accepted. For existing users, material changes take effect no earlier than 30 calendar days after notice, unless separately accepted sooner.

Changes required by law or necessary to address a security threat may apply sooner to the necessary extent; we will explain the reason and date. Editorial clarifications that do not disadvantage users may apply upon publication. A new revision does not retrospectively alter accrued claims.

17. Severability

If a provision cannot be enforced, the remainder continues to the extent lawful. An invalid term is not automatically replaced by a more burdensome one. Ambiguities in consumer contracts are interpreted subject to mandatory consumer-protection rules.

18. Law and disputes

UAE law and applicable laws of the Emirate of Dubai apply, without depriving you of mandatory protection under the applicable law of your habitual residence.

Competent Dubai courts hear disputes unless mandatory law gives you a right, or requires you, to use another court. Contacting support does not restrict recourse to a regulator or court and does not automatically suspend statutory time limits.

19. Documents and languages

The Terms set contractual rules, this Disclaimer explains risks, and the Privacy and Cookie Policies explain data processing. None overrides mandatory law.

Translations are intended to convey the same meaning. A language clause does not remove protection associated with the text provided to you. Mandatory Arabic-language requirements in the UAE remain applicable.
